Great Guitar Giveaway Inc. — Sweepstakes Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.

1. Sponsor

This Sweepstakes is sponsored by Great Guitar Giveaway Inc., [street address], [city, state, ZIP] ("Sponsor"). All inquiries regarding the Sweepstakes should be directed to hello@greatguitargiveaway.com.

2. Eligibility

The Sweepstakes is open only to legal residents of the fifty (50) United States and the District of Columbia who are eighteen (18) years of age or older at the time of entry. Employees, officers, directors, and agents of the Sponsor, its parent companies, subsidiaries, affiliates, advertising and promotion agencies, and members of the immediate family (spouse, parent, child, sibling, and their respective spouses, regardless of where they reside) and persons living in the same household, whether or not related, of any of the above are not eligible to enter or win.

The Sweepstakes is void in the U.S. territories of Puerto Rico, Guam, the U.S. Virgin Islands, American Samoa, the Northern Mariana Islands, and any other jurisdiction outside the fifty United States and the District of Columbia. The Sweepstakes is also void wherever else prohibited or restricted by law.

By participating, entrants agree to be bound by these Official Rules and the decisions of the Sponsor, which are final and binding in all matters relating to the Sweepstakes.

3. Sweepstakes Period

Each individual draw within the Sweepstakes ("Draw") has its own entry period, which is published on that Draw's product page. The opening date and time and the closing date and time of each Draw are stated in Pacific Time on the relevant page. Entries received outside of a Draw's published entry period will not be eligible for that Draw.

4. How to Enter

There are two methods of entry. Both methods carry equal weight, and using one method does not improve a participant's chance of winning.

Method 1 — Online Entry (Paid). Visit greatguitargiveaway.com, select an active Draw, choose an entry tier, complete the entry form with the required information (name, email, date of birth, mailing address), and submit payment for the selected tier. Entries are credited to the participant's account upon successful payment processing. Entry tiers and entry quantities are listed on the entry form.

Method 2 — Free Mail-In Entry (No Purchase Necessary). To enter without a purchase, hand-print on a 3" × 5" card the following: your full name, complete mailing address, email address, date of birth, daytime telephone number, and the Draw number you wish to enter (e.g., "Draw No. 017"). Mail the card in a hand-addressed envelope, with sufficient postage, to:

Each completed mail-in card received is one (1) free entry. Limit one (1) free entry per outer mailing envelope. Mail-in entries must be postmarked on or before the Draw's closing date and received within seven (7) calendar days of the closing date to be eligible. Sponsor is not responsible for lost, late, illegible, postage-due, misdirected, mutilated, garbled, or incomplete entries; all such entries are void. Mechanically reproduced entries are not permitted. Sponsor reserves the right to disqualify any entry that does not meet these requirements.

5. Entry Limits

There is no per-person limit on the total number of paid entries a participant may submit per Draw, except that participants may not submit more entries than the total entry pool advertised for that Draw. There is a limit of one (1) free mail-in entry per outer mailing envelope, but no limit on the number of free mail-in entries any one participant may submit per Draw. Each entry, paid or free, is treated identically for the purpose of winner selection.

6. Prize and Approximate Retail Value

Each Draw awards one (1) prize: the specific guitar identified on that Draw's product page, including any case, accessories, certificates of authenticity, or documentation listed on that page. The Approximate Retail Value (ARV) of each prize is stated on the relevant product page. ARVs are based on the manufacturer's suggested retail price or, where applicable, comparable market value at the time of the Draw's listing.

The prize is non-transferable and may not be substituted, except that the Sponsor reserves the right, at its sole discretion, to substitute a prize of equal or greater value if the advertised prize becomes unavailable for any reason. No cash equivalent or other substitution will be offered to the winner.

Shipping is included within the contiguous United States. Sponsor is responsible for arranging fully insured shipping of the prize to the verified winner's mailing address. Winners residing in Alaska or Hawaii may be required to coordinate alternative shipping arrangements with the Sponsor. The winner is solely responsible for any taxes (federal, state, or local), insurance beyond shipping insurance, customs duties, or other charges or costs associated with acceptance, possession, or use of the prize.

7. Odds of Winning

Odds of winning a given Draw depend on the total number of eligible entries received for that Draw across both entry methods, divided by the number of entries credited to a given participant. The total entry pool size for each Draw is published on the Draw's product page. By way of example, if a Draw has a total pool of 5,000 entries and a participant holds 25 entries, that participant's odds of winning are approximately 1 in 200.

8. Winner Selection and Notification

For each Draw, one (1) winner will be selected by random drawing from all eligible entries received during that Draw's entry period. The drawing will be conducted by the Sponsor or a designated third party using a randomization method that gives every eligible entry an equal chance of selection. The drawing for each Draw will occur within seven (7) business days of that Draw's closing date.

The selected winner will be notified by email at the address provided on their entry, within seven (7) business days of the drawing. The potential winner will be required to respond to the notification within five (5) business days and complete and return any required documentation, including but not limited to an Affidavit of Eligibility, Liability Release, and (where lawful) Publicity Release, within ten (10) business days of receipt. Failure to respond to notification, failure to return required documentation within the stated time, return of notification or documentation as undeliverable, or non-compliance with these Official Rules will result in disqualification, and an alternate winner may be selected by random drawing from the remaining eligible entries.

9. Verification

The selected winner is subject to verification by the Sponsor, including but not limited to verification of identity, age, residency, and eligibility under these Official Rules. The Sponsor reserves the right to require government-issued identification and proof of address. The Sponsor's decisions regarding eligibility and winner selection are final and binding.

10. Publicity

By accepting a prize, the winner grants the Sponsor permission to use the winner's first name, last initial, city and state of residence, photograph, and a likeness of the winner with the prize for promotional purposes in any media, worldwide, in perpetuity, without further compensation, except where prohibited by law. Winners who decline to be photographed or named will receive their prize without forfeiting any other rights under these Rules.

11. Taxes

All federal, state, and local taxes, and any other costs or expenses associated with prize acceptance and use, are the sole responsibility of the winner. For prizes with an ARV of $600 or more, the Sponsor is required to issue an IRS Form 1099-MISC reporting the prize value to the U.S. Internal Revenue Service. The winner will be required to provide a valid U.S. taxpayer identification number (Social Security Number or equivalent) prior to receiving the prize for tax reporting purposes.

12. General Conditions

The Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Sweepstakes or any Draw within it, in whole or in part, if any fraud, technical failures, or any other factor beyond the Sponsor's reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by the Sponsor. In such event, the Sponsor will, where feasible, select winners from all eligible entries received prior to the action that prompted the modification, cancellation, or termination. In the event of cancellation prior to the drawing, paid entrants will receive a refund of paid entry fees within thirty (30) calendar days.

The Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes; to be acting in violation of these Official Rules; or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, or harass any other person.

CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

13. Release of Liability

By participating, entrants agree to release, discharge, and hold harmless the Sponsor and its parent companies, subsidiaries, affiliates, partners, advertising and promotion agencies, and each of their officers, directors, employees, agents, successors, and assigns, from any and all liability, claims, demands, damages, losses, costs, and expenses arising out of or in connection with participation in the Sweepstakes, acceptance, possession, use, or misuse of any prize, or any travel or activity related thereto, including without limitation any claim for personal injury, death, or property damage.

14. Disputes and Governing Law

Except where prohibited, entrants agree that any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in [state of incorporation], to the jurisdiction of which the entrant submits. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of the entrant and the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of [state of incorporation], without giving effect to any choice of law or conflict of law rules.

15. Privacy

Information submitted in connection with the Sweepstakes is collected by the Sponsor and used in accordance with the Sponsor's Privacy Policy, available at greatguitargiveaway.com/privacy-policy. By entering, participants consent to the collection, use, and disclosure of their personal information as described therein.

16. Winners List

For a list of winners (available approximately thirty (30) days after each Draw's closing date), visit greatguitargiveaway.com/past-winners or send a self-addressed, stamped envelope to:
